IMPORTANT, READ CAREFULLY: YOUR USE OF THE SENZON LEARNING WEBSITE AND THE EDUCATIONAL COURSES ACCESSED FROM THE SENZON LEARNING WEBSITE (THE “SERVICES”) IS CONDITIONED UPON YOUR COMPLIANCE AND ACCEPTANCE OF THESE TERMS.

BY ACCESSING THE SENZON LEARNING WEBSITE OR BY USING THE EDUCATIONAL COURSES ACCESSED FROM THE WEBSITE, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. THE SERVICES ARE NOT AVAILABLE TO PERSONS UNDER 18 YEARS OF AGE.

CONTINUING EDUCATION CREDITS. While Senzon Learning, Inc. attempts to periodically verify the number of hours accepted for the completion of courses from the Senzon Learning website to fulfill continuing education requirements by various agencies, the policies of such agencies are subject to change, and as such Senzon Learning, Inc. does not warranty the extent to which any particular agency will accept courses from the Senzon Learning website in fulfilling such requirements. You should contact the agency that governs your continuing education requirements to confirm the credit accepted for specific courses taken from the Senzon Learning website.

RESPONSIBILITY FOR REGISTRATION INFORMATION. You are entirely responsible for maintaining the security of your user name and password and agree not to disclose such to any third party.

LIMITATIONS ON USE. The Services may be used for your individual educational purposes only. You will not reproduce, resell, or distribute the Services for any purpose unless you have been specifically permitted to do so under a separate agreement with Senzon Learning, Inc.

COPYRIGHT. You may not post, modify, distribute, or reproduce in any way copyrighted material, trademarks, rights of publicity or other proprietary rights of Senzon Learning, Inc. without obtaining the prior written consent of Senzon Learning, Inc.. Senzon Learning, Inc. may deny access to the Services to any person who is alleged to infringe these rights.

INJUNCTIVE RELIEF. You acknowledge that any use of the Services contrary to this agreement, or any transfer, sublicensing, copying or disclosure of technical information or materials related to the Services, may cause irreparable injury to Senzon Learning, Inc., and under such circumstances Senzon Learning, Inc. will be entitled to equitable relief, without posting bond or other security, including, but not limited to, preliminary and permanent injunctive relief.

INFORMATIONAL CONTENT DISCLAIMER. THE INFORMATION PROVIDED ON THIS WEBSITE AND THE EDUCATIONAL SERVICES ACCESSED FROM THIS WEBSITE ARE PROVIDED “AS IS” AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, MERCHANTABILITY OF ANY PRODUCT, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF INFORMATIONAL CONTENT, OR NON-INFRINGEMENT. SENZON LEARNING, INC.’S MAXIMUM LIABILITY FOR ANY INACCURATE INFORMATION AND YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE WHATSOEVER, SHALL BE LIMITED TO THE AMOUNT PAID BY YOU TO SENZON LEARNIING, INC. (IF ANY). SENZON LEARNING, INC. IS NOT LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, LOSS OF BUSINESS, LOSS OF PROFITS OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT, NEGLIGENCE, PRODUCT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. You agree to indemnify, defend and hold harmless Senzon Learning, Inc., its affiliates, officers, directors, members, employees, consultants, and agents from any and all third party claims, liability, damages and/or costs (including, but not limited to, attorneys’ fees) arising from your use of the Services, your violation of this agreement or the infringement or violation by you or any other user of your account, of any intellectual property or other right of any person or entity.

AMENDMENTS. Senzon Learning, Inc. reserves the right to amend these policies at any time. Senzon Learning, Inc. will post a notice of changes on its website, when and if the terms of any of its policy are amended.

CHOICE OF LAW AND FORUM. This agreement shall be governed by and construed under the laws of the State of North Carolina, as applied to agreements entered into and to be performed in North Carolina by North Carolina residents. The parties consent to the exclusive jurisdiction and venue of the courts located in and serving Buncombe County, North Carolina.

REFUND POLICY: There will be no refunds for courses taken on SenzonLearning.com. If you are dissatisfied with a course, please contact us and we will register you with a replacement course when one is available.

MEMBERSHIP RENEWALS: Monthly and yearly memberships are set to automatically renew. You can upgrade or cancel your membership anytime by clicking on the dashboard link in the information icon on the header.
